Medical Records and Your Claim File
The Social Security Administration will accept medical records which do not contain a physician's signature and are copies.
The SSA Form 827 is signed by the claimant and used by the SSA to request medical records from each provider identified in your SS Application including:
- Treating physician
- Therapists
- Hospitals
- Other health care provider
The SSA is obligated to pay $10 for each set of records requested.
You must provide the name and address of the health care provider
The SSA will send a form letter to the health care provider to obtain the records.
You need to pay particular attention to three elements of your claims rep’s gathering of medical records:
- Follow up with your doctor, hospital or health care provider to be certain the records have been provided. The SSA will base their decision on INCOMPLETE records which means your claim may be denied.
- Doctors use copy services to produce medical records and some of these services choose to ignore request from Social Security since there is no money involved, again FOLLOW UP.
- Once a hearing request is filed, the SSA claim representative claims representative is relieved of his duties in your case and you or your lawyer is solely responsible for updating the medical and vocational records. The delay between hearing request and the actual scheduling of a hearing can be one to two years.
